Plain copies of case records cost $1 per page. Certified copies cost $1 per page with an additional $5 certification fee per document. Payments can be made by money orders, cashier's checks, or cash. The Office does not collect personal business checks.

Civil and criminal name searches cost $5 per name per 10-year search. Requests should be made with the complete name (first, middle & last) and time period to be searched. The clerk's Office also provides civil and criminal records data through a CD, FTP file, or e-mail. The service charge is $9.35 per request.

Montgomery County Civil Court Case Records

Civil records are legal documents and other information related to a civil case maintained by a Montgomery Court. The Montgomery County Clerk's Office maintains records on civil suits filed in the Courts at Law that do not exceed $500. They also keep records of cases appealed by the Justice of the Peace Courts. The Montgomery County District Clerk handles civil cases in amounts greater than $500, family matters (like divorce and condemnations), and all juvenile cases.

Interested persons can request civil court case records online or in person at the Montgomery County Clerk's Office. Montgomery County Criminal Court Case Records

A criminal record is a case file or document of offenses that a person has been convicted of because they have either pleaded guilty or have been found guilty. The Montgomery County Clerk maintains records of Class A and B misdemeanor cases like DWIs, thefts, and assaults. Felony records are maintained at the District Clerk's Office. Criminal court case records can be retrieved online or in person at the Montgomery County Clerk's Office. Online requesters can access the "Odyssey Public Access" tool and select "Criminal Records". The search parameters are by case, defendant, citation, attorney, or date filed. Only records of misdemeanor cases can be obtained in person at the County Clerk's Office. In-person requests for felony cases should be made at the District Clerk's Office.

Montgomery Courts provide free access to court records on the custodian's website. Here is how to get court records for free on the Montgomery County Clerk's website:

  • Go to the homepage and scroll down the left navigation page
  • Click the "Civil, Criminal Misd., Probate Records Search" link, which leads to the "Odyssey Public Access" page
  • Select a location
  • Select the "Criminal Records" or "Civil & Probate Case Records" link
  • If the "Criminal Records" link was selected, conduct a search by Case, Defendant, Citation, Attroney, or Date Filed
  • If the "Civil & Probate Case Records" link was selected, conduct a search by case, party, attorney, or Date Filed.
  • Regardless of the case type, click the Search button to conduct the search.
